You​ ​agree​ ​to​ ​indemnify,​ ​defend​ ​and​ ​hold​ ​harmless​ ​Kelly Ann McKechnie ​and​ ​our​ ​parent, subsidiaries,​ ​affiliates,​ ​partners,​ ​officers,​ ​directors,​ ​agents,​ ​contractors,​ ​licencors, service​ ​providers,​ ​subcontractors,​ ​suppliers,​ ​interns​ ​and​ ​employees,​ ​harmless​ ​from​ ​any claim​ ​or​ ​demand,​ ​including​ ​reasonable​ ​attorneys’​ ​fees,​ ​made​ ​by​ ​any​ ​third-party​ ​due​ ​to​ ​or arising​ ​out​ ​of​ ​your​ ​breach​ ​of​ ​these​ ​Terms​ ​of​ ​Service​ ​or​ ​the​ ​documents​ ​they​ ​incorporate by​ ​reference,​ ​or​ ​your​ ​violation​ ​of​ ​any​ ​law​ ​or​ ​the​ ​rights​ ​of​ ​a​ ​third-party.

Severability.

Termination.

These​ ​Terms​ ​of​ ​Service​ ​are​ ​effective​ ​unless​ ​and​ ​until​ ​terminated​ ​by​ ​either​ ​you​ ​or​ ​us.​ ​You may​ ​terminate​ ​these​ ​Terms​ ​of​ ​Service​ ​at​ ​any​ ​time​ ​by​ ​notifying​ ​us​ ​that​ ​you​ ​no​ ​longer​ ​wish to​ ​use​ ​our​ ​Services,​ ​or​ ​when​ ​you​ ​cease​ ​using​ ​our​ ​site.

Entire Agreement.

The​ ​failure​ ​of​ ​us​ ​to​ ​exercise​ ​or​ ​enforce​ ​any​ ​right​ ​or​ ​provision​ ​of​ ​these​ ​Terms​ ​of​ ​Service shall​ ​not​ ​constitute​ ​a​ ​waiver​ ​of​ ​such​ ​right​ ​or​ ​provision.

Changes to Terms of Service.

You​ ​can​ ​review​ ​the​ ​most​ ​current​ ​version​ ​of​ ​the​ ​Terms​ ​of​ ​Service​ ​at​ ​any​ ​time​ ​at​ ​this​ ​page. Refunds and Returns.

Due​ ​to​ ​the​ ​sharing​ ​of​ ​intellectual​ ​material​ ​there​ ​are​ ​no​ ​refunds​ ​or​ ​returns​ ​on​ ​Services​ ​or any​ ​Programs​ ​on​ ​this​ ​website.​ ​Individuals​ ​registering​ ​for​ ​online​ ​coaching​ ​packages​ ​must complete​ ​all​ ​weeks​ ​by​ ​the​ ​expiration​ ​date​ ​of​ ​the​ month their plan was most recently paid through. They must notify Kelly Ann McKechnie of their intention to cancel subscription prior to the following month of subscription payment in a written form to prove date and decision to end contract. Individuals must then cancel their membership on the TRI KAM TRAINING website to effectively end their membership subscription and billing. Failure to do so will result in another month of training, that will not be refunded. Prices are not prorated. The full month purchased will be offered and delivered, before that month end, the client must inform of intent to terminate before their next scheduled payment and cancel their subscription theirselves before next payment date arrives.

Each​ ​participant​ ​(herein​ ​referred​ ​to​ ​as​ ​the​ ​“Participant”)​ ​of​ ​a​ KellyAnn McKechnie/TRI KAM TRAINING in-person​ ​or​ ​online​ ​personal​ ​training​ ​program,​ ​nutrition​ ​or​ ​dietary​ ​advice​ ​program​ ​or other​ ​fitness​ ​program​ ​(collectively​ ​referred​ ​to​ ​herein​ ​as​ ​the​ ​“Program”)​ ​is​ ​aware​ ​that participation​ ​in​ ​any​ ​sport​ ​or​ ​physical​ ​exercise​ ​program​ ​and​ ​use​ ​of​ ​any​ ​equipment,​ ​gym or​ ​fitness​ ​facility​ ​may​ ​result​ ​in​ ​accident​ ​or​ ​injury​ ​and​ ​that​ ​any​ ​change​ ​in​ ​diet​ ​or​ ​nutrition may​ ​result​ ​in​ ​positive​ ​or​ ​adverse​ ​changes​ ​to​ ​your​ ​body​ ​and​ ​overall​ ​health​ ​or​ ​medical condition.​ ​Accordingly,​ ​Participant​ ​acknowledges​ ​that​ ​all​ ​Programs​ ​are​ ​provided​ ​on​ ​an “as​ ​is”​ ​basis​ ​and​ ​agrees​ ​to​ ​assume​ ​the​ ​full​ ​risk​ ​of​ ​participation​ ​in​ ​any​ ​Program​ ​provided or​ ​recommended​ ​by​ Kelly Ann McKechnie,​ ​Kelly Ann, TRI KAM TRAINING​ ​or,​ ​any​ ​other​ ​trainer​ ​working​ ​for​ ​or​ ​on behalf​ ​of​ Kelly Ann McKechnie/TRI KAM TRAINING,​ ​or​ ​any​ ​affiliate​ ​thereof​ ​(each​ ​of​ ​such​ ​persons​ ​and​ ​entities and​ ​their​ ​respective​ ​owners,​ ​members,​ ​officers,​ ​employees,​ ​independent​ ​contractors, affiliates,​ ​successors​ ​and​ ​assigns​ ​are​ ​referred​ ​to​ ​herein​ ​individually​ ​and​ ​collectively​ ​as “TRI KAM TRAINING.”).

In​ ​consideration​ ​of​ ​my​ ​participation​ ​in​ ​or​ ​use​ ​of​ ​the​ ​Program,​ ​Participant​ ​hereby irrevocably​ ​releases​ TRI KAM TRAINING and Kelly Ann McKechnie,​ ​and​ ​waives​ ​and​ ​covenants​ ​not​ ​to​ ​sue​ ​or​ ​seek reimbursement​ ​from​ ​TRI KAM TRAINING or Kelly Ann McKechnie​ ​for​ ​any​ ​and​ ​all​ ​present​ ​or​ ​future​ ​claims, demands,​ ​damages,​ ​losses,​ ​adverse​ ​consequences,​ ​liabilities​ ​and​ ​causes​ ​of​ ​action arising​ ​from:​ ​(1)​ ​Participation​ ​in​ ​or​ ​use​ ​of​ ​any​ ​of​ ​TRI KAM TRAINING’s​ ​Programs, including​ ​exercise​ ​activities​ ​and​ ​nutrition​ ​recommendations​ ​(including,​ ​without limitation,​ ​any​ ​personal​ ​injury,​ ​death,​ ​allergic​ ​food​ ​reactions,​ ​property​ ​damage​ ​or​ ​other losses);​ ​Further,​ ​Participant​ ​agrees​ ​to​ ​indemnify,​ ​defend​ ​and​ ​hold​ ​harmless​ ​TRI KAM TRAINING and Kelly Ann McKechnie ​from​ ​any​ ​and​ ​all​ ​claims,​ ​demands,​ ​causes​ ​of​ ​action,​ ​costs​ ​and​ ​fees (including​ ​attorneys’​ ​fees)​ ​damages,​ ​losses​ ​and​ ​liabilities​ ​arising​ ​from​ ​(1).

Participant​ ​is​ ​entering​ ​into​ ​a​ ​personal​ ​training,​ ​nutrition​ ​and​ ​motivation​ ​training​ ​Program with​ ​the​ ​understanding​ ​that​ ​Participant​ ​has​ ​full​ ​responsibility​ ​for​ ​his/her​ ​health,​ ​physical, mental,​ ​emotional,​ ​and​ ​spiritual​ ​well-being.​ ​Participant​ ​acknowledges​ ​that​ ​TRI KAM TRAINING or Kelly Ann McKechnie,​ ​has​ ​not​ ​and​ ​will​ ​not​ ​render​ ​any​ ​medical​ ​services​ ​or​ ​provide​ ​any​ ​medical diagnosis​ ​or​ ​advice​ ​regarding​ ​his/her​ ​physical​ ​or​ ​medical​ ​condition.​ ​Participant represents​ ​and​ ​warrants​ ​to​ ​TRI KAM TRAINING ​that​ ​he/she​ ​is​ ​in​ ​good​ ​health,​ ​has​ ​all necessary​ ​medical​ ​approval​ ​to​ ​participate​ ​in​ ​or​ ​use​ ​the​ ​Program​ ​and​ ​is​ ​otherwise competent​ ​and​ ​qualified​ ​to​ ​participate​ ​in​ ​or​ ​use​ ​the​ ​Program.​ ​Participant​ ​agrees​ ​that​ ​if​ ​at any​ ​time​ ​he/she​ ​believes​ ​it​ ​is​ ​unsafe​ ​for​ ​him/her​ ​to​ ​participate​ ​in​ ​any​ ​component​ ​of​ ​the Program​ ​or​ ​its​ ​activities​ ​or​ ​to​ ​follow​ ​its​ ​recommendations​ ​or​ ​advice,​ ​Participant​ ​will immediately​ ​discontinue​ ​his​ ​or​ ​her​ ​participation​ ​or​ ​use​ ​of​ ​the​ ​Program.

Participant​ ​acknowledges​ ​and​ ​agrees​ ​that​ ​this​ ​Agreement​ ​is​ ​binding​ ​on​ ​Participant​ ​as well​ ​as​ ​his/her​ ​child/ward,​ ​heirs,​ ​executors,​ ​administrators,​ ​and​ ​assigns,​ ​and​ ​anyone​ ​else who​ ​may​ ​assert​ ​a​ ​claim​ ​on​ ​Participant’s​ ​behalf.​ ​This​ ​Waiver​ ​and​ ​Release​ ​shall​ ​be​ ​deemed to​ ​be​ ​severable​ ​and,​ ​if​ ​any​ ​provision​ ​hereof​ ​shall​ ​be​ ​finally​ ​determined​ ​to​ ​be​ ​void,​ ​illegal or​ ​unenforceable,​ ​then​ ​it​ ​is​ ​the​ ​parties’​ ​desire​ ​and​ ​intention​ ​that​ ​such​ ​provision​ ​be deemed​ ​automatically​ ​adjusted​ ​to​ ​the​ ​minimum​ ​extent​ ​necessary​ ​to​ ​conform​ ​to applicable​ ​requirements​ ​of​ ​validity,​ ​legality​ ​and​ ​enforceability​ ​and,​ ​as​ ​so​ ​adjusted,​ ​be deemed​ ​a​ ​provision​ ​of​ ​this​ ​Waiver​ ​and​ ​Release​ ​as​ ​if​ ​it​ ​were​ ​originally​ ​included​ ​herein. PARTICIPANT​ ​HAS​ ​CAREFULLY​ ​READ​ ​AND​ ​UNDERSTANDS​ ​THE​ ​CONTENTS​ ​OF​ ​THIS BINDING​ ​WAIVER​ ​AND​ ​RELEASE​ ​WITH​ ​FULL​ ​KNOWLEDGE​ ​OF​ ​ITS​ ​LEGAL SIGNIFICANCE.

HIPPA.

In some events, medical and health records are required prior to any type of training being provided. This is to ensure client safety and health. This is information is safely stored and under no circumstances will it be shared with anyone besides Kelly Ann McKechnie, herself. If medical history is asked for, but the prospective client declines to provide, training service may be declined by Kelly Ann McKechnie at her discretion, in which case a refund will be made, if the prospective clients requests.
